New California Law Fights Against Pregnancy Discrimination in the Workplace

New anti-discriminatory laws have been passed in California, making it more difficult for businesses and workplaces in the city of Los Angeles to continue in any illegal pregnancy discrimination. As of April 1, 2016, the new California FEHA regulations protect pregnant women from illegal discrimination and pregnancy harassment by creating a number of requirements workplaces must fulfill.

Discrimination in the workplace is effectively combatted through protective anti-discriminatory laws such as this new FEHA regulation where amendments to existing laws call for additional anti-harassment policies to be made and enforced in the workplace. In addition, the amendments and laws provide new requirements for sexual harassment training, helping combat illegal sexual harassment and sexual discrimination in the workplace. As of April 1, 2016, discriminatory harassment and retaliation policies must explicitly state what protected categories are, rather than giving out a generic statement. Additionally, the new laws mandate a confidential complaint process that ensures a timely response. Investigations into discrimination complaints must be carried out expeditiously and fairly, allowing for discrimination complaints and misconduct to be handled in a manner that is in accordance with the law. Anti-discrimination policies must also be explicitly stated and written, as must anti-harassment policies.

In addition to laws combatting pregnancy discrimination in the state of California, the new FEHA regulations add broadened definitions to gender discrimination regulations, making it more difficult for employers to practice any type of illegal sex discrimination in the workplace. The new regulations add protection for different types of gender expression including transgender individuals. By adding regulations preventing illegal gender discrimination against transgender people, illegal transgender discrimination is now more effectively fought.
